Legal cost to transfer property title to spouse

    Following a separation, my spouse is buying me out of our home. I've to get a solicitor to handle my end to transfer my interest in the family home and to receipt of payment.

    Has anyone experience of specifically this and what costs and time frame it takes?

    Hi. I've just been through this process. Separated from my wife, and I bought her out of the family home.

    Ignoring the separation costs, the house transfer costs were -
    Solicitor - €1230
    Commissioner for Oaths - €10
    Land Registry Fees - €345
    Requisition of copy folio - €5

    So - a total of €1590 to take ownership.

    And it took around 2 months in total.

    do you mind me asking what the separation fees were and did court decide what way things were split or who got house

    No court involved. That's going down the judicial separation route. We mediated ourselves, and drafted a separation agreement through our respective solicitors. Cost around 3.5k each for that document. And I paid all of the house transfer fees, as I was taking ownership.

    We were advised that if we went judicial, and need barristers etc, then prepare to spend 25k each. So we did it amicably.

    Go to your solicitor. Ask for a price up front. And try to mediate an agreement with your partner ... it's better for everyone really.

    But what did it cost her for the property transfer? We did a deed of separation mediating ourselves without solicitors and got witnesses. But my solicitor for the mortgage says my wife does need a solicitor to deal with her side of the transfer and receiving the money.

    There doesn't seem to much involved on her side as it's mainly me dealing with the remortgage and registry fees etc.

    Good question - I'm not sure as she had a solicitor already retained for processing separation agreement - so her signing some docs around the deeds just fell under that banner.
