Revenue: Arrears.Overpayments and ongoing issues

    OK.
    A long story short.
    Approx 15 years ago Revenue ,by their own admission, estimated I overpayed by 5000 pounds.To my memory I never received this and when I followed up they fobbed me off and never sent me any relevant documentation about the payment despite asking for it.
    For my troubles I , of course ,got audited.
    And was found to have underpaid for the years 05,06,07,08 and 09.Needless to say interest and penalties were added onto it very soon after.

    So I Paid what I believe to be 2005 off first.

    Then the 'capital' off 2006 directly to Revenue but the was then sent to the Sherriff with whom I have been dealing with ever since without issue.
    I rang them this morning asking to see how much was left firmly in the belief it was no more then a couple of hundred quid.
    They came back after 'consultation' with revenue with a figure of almost 2,500.
    WTF!!!

    The only combination of that I can even get close to this amount is that they havent counted the 2006 'capital' plus what I paid via online this am (not showing up yet). But thats still a bit off.

    I am know begining to think that they are picking numbers out of their arses!
    I have kept a spreadsheet of when and how I payed

    So do I pay it and deal with it,put it behind me or get a decent tax consultant to see wtf is going on?

    What you really need is a list from them of all the payments they have recorded as paid, directly and via the sheriff. Then do a reconciliation to your list.

    Have you factored in sheriffs fees which will have been deducted from your payments via them and also interest which may have been clocking up on the balance ?

    Yep I have factored in the fees as I was told up front that their fees were taken first.

    Will interest be still acruing once with the sheriff?

    The sheriff normally only has limited time to execute warrants but I think they can negotiate phased payment arrangements of up to 2 years. Normally if a phased payment is with Revenue then interest to cover the 2 years would be built in. If you are on reasonable terms with the sheriff staff it might be worth asking.

    If you haven't done so already, request statements of account for each year going back to 2003 (or whenever this issue started), to cover each of your taxheads (ie, capital gains, income tax etc). The statement of account will show, in each year, the balance due/owed or balanced for that year. Won't solve your problem exactly but it will show you what Revenue is looking at when they say there is another two and a half grand showing and you will have all of the figures on a set of identical documents, which should make things easier. Basically you should be able to figure out from the statements of account where they are getting that figure and identify the discrepancy, if any.

    I would also call the Collector General's and ask them directly where this liability is arising, on the off-chance they can tell you.
