Planning Permission Extension Question

    Hi All

    I'd really appreciate if somebody could help me with the following.

    We are looking to buy a house. The property appears to have been extended in the past 5-10 years by adding the an extra bedroom above the garage. I estimate that extension to be circa 30 square metres. However, we are now looking to buy the house and further extend a kitchen onto the back of the house (circa a further 30 sq metres). I am aware that there is a limit of circa 40 square metres before requiring planning permission and i would like to know if we would require planning permission post purchasing the house. ie, does the requirement for further planning permission pass once a property changes hands?

    I may be misunderstanding your question but if I'm getting it right you would require permission as the permission/any exemptions apply to the property rather than the owner.

    That’s what I thought/feared. So the original owner was perfectly entitled to extend over the garage but if we were to extend further, it would his extension plus our extension which would need to be less than 40 sq metres

    Incorrect. The extension over the garage required planning permission.
    You can enjoy the 40 square meter exemption to the rear if they have official planning for the first floor extension at the side. If they don’t, then technically you need retention of that before you can enjoy any exemption.

    The 40 sq m exempted extension to the rear must include any extension carried out since 1st October 1964 whether it has planning permission or not. my view only
