Bank holiday entitlement

Sorry if this has been asked before - i started a new job on 23rd July and worked for 40 hours that week and was paid for that week. Salary is paid monthly and is paid on 10th of every month. I received full pay for month of August but was only paid 2.8 hours. I have been told that i must have worked for five weeks before the bank holiday and that i only worked one week before 6th August when the bank holiday occurred. Is this correct? It says in legislation that you have to work 40 hours in the five weeks before bank holiday to be entitled to a full day. Is it five full weeks or just 40 hours over the five weeks. I am confused.

Can you clarify what you mean here?

I was paid for all hours I worked in August (176 hours) - I work 40 hours per week, but was only paid for 2.8 hours for the bank holiday.

Are you a part-time or full time worker? It is my understanding that it only applies to part time / casual working and yes it's based on whether you've worked more than 40 hours over a 5 week period - if you don't work it you are entitled to 1/5 of the working week but if you don't have full time hours (40 hours = 1 day off) it is calculated on the average hours per week worked out on the previous 5 weeks and then 1/5 of that..

    W1 10 hours
    W2: 22 hours
    W3: 34 hours
    W4: 16 hours
    W5: 2 hours
    Total: 84 hours
    Average 16.8
    1/5 : 3.36 hour bank holiday payment

Apologies - just read there about the 176 hours. In my opinion, they've miscalculated it. I would bring it back to them and ask them to look into it further. I'd also call citizen's info to clarify it and explain that to them

Just to clarify i have now been paid for the extra hours I was owed for the bank holiday. Obviously they did not know the legal entitlements!
