21 days to fix or it having travelled less than 4,000km so yes you can use it once you travel less than 4,000km...
    Fail Test Report

If you receive a fail test report it means that your vehicle has failed the CVR test. The vehicle owner must get the vehicle repaired and re-present it for a CVR retest at the same testing centre within 21 days or it having travelled less than 4,000 km.

When your vehicle completes and passes the retest, we will automatically issue a CRW to the registered owner of the vehicle.

Well u get 21 days from date of cvrt to carry out repairs and if it fails you can still use it BUT only until cvrt annual disc runs out however this is only for fail minor ..if it fails major its deemed unroadworthy..you can test only 30 days before cvrt expires but lots people wait until test date has passed.. so to your original question..
Answer is clear. Regardless of when its tested you are only legal as long as your annual disc has not expired..otherwise 3 penalty points and that's from an rsa inspector only last week.. save the hassle get cvrt carried out at least 2 weeks before it expires then you have adequate time for repairs . Unless van fails major...

Scroll down further to the classifications. You can’t drive with certain fails

It's dated 1 year from the test pass date, so if it expires September 14th for example, passing the test on September 1st will mean 2 weeks lost off the previous years cert. Unlike the NCT where if you got it tested July 20th for example, your next NCT cert would expire September 14th the next year(s).
