Council and an Bord Pleanala conditions combined?

    Hi
    We have planning from Meath co co for some time. The permission was objected to and the objections overturned with planning granted by an Bord Pleanala. There were conditions with both. We thought conditions of on bord Pleanala replaced the council's. Now we see the council reiterating theirs during commencement.

    Can a home clarify: are conditions cumulative or do on bord Pleanala conditions replace the council's?

    Only the ABP conditions apply. ABP revisit the entire application and not just the subject items of an appeal. See items 18 and 20 http://www.pleanala.ie/guide/appeal_guide.htm

    Agreed, ABPs conditions take precedent.

    However sometimes they make reference to, or be very similar to, councils conditions. (ie development contributions)

    But if the council are trying to make you do something the bord haven't asked for, or aren't applicable under some other law, tell them to take a hike
