Mortgage/ Deed name removal fees

    Hi Guys ,

    After years of banging my head against a brick wall I’ve eventually got Pepper asset management to agree to remove my ex wife’s name from the Mortgage/ Deeds without having to apply for a new mortgage. So same mortgage agreement just removing my ex wife’s name ( bless her I’ll miss seeing her name on the statements 😂) Anyway I’ve contacted my solicitor who quoted me €3000 to have this done. I’m going to shop around, does anyone know the going rate? Can I do this myself ? Most of the quotation was for government charges so I assume I could apply for these myself.

    The easiest way to think about it is that there are a few ways of doing this ie changing it all to your name depending on your situation. 1 via the courts where it would be part of a divorce ie a property registration order cheaper. Or two a transfer of ownership which is similar to solicitor fees for buying a property ie solicitor fee property registration fee stamp duty ect. Both cost some money but second one doesn't require a solicitor But is difficult to do without. You should go with a solicitor for your protection and just call around for prices.

    All these things seem easy until they are not. Particularly if you are dealing with a company like Pepper a solicitor is the only option it will break your heart trying to deal with everything otherwise.

    This is essentially a property transfer. The property is being transferred from (A) your ex and you jointly to (B) you. Associated with this is a renewal of a (1) loan agreement, and (2) a mortgage document. Currently these are between you and your ex jointly, as borrowers, and the bank as lender; they both need to be replaced with agreements between you and the lender.

    In short, from a technical and documentation point of view this is not that different from a sale of the property by you and your ex to a new purchaser, who is getting a mortgage. The fact that (I assume) no money is changing hands doesn't simplify the legal issues or processes. You're on both the "selling" and "buying" sides of the transaction.

    You cannot do this yourself. I've no idea what the going rate for the conveyancing work is, but it won't be trivial.
