Change of ownership form not gone through

    Sold my car to a dealer months ago and gave him the change of ownership form as he was to sell it on but he hasnt and obviously still hans't sent in the form as i have got letters re tax renewal and one concerning a recall issue. Now im just wondering if he is caught by a Go safe van etc could i be liable? Im sure he would take the rap but how would we go about that? And yes i will sort the form issues etc immediately but still im just curious

    What kind of 'dealer' is he? If he's an indie then he probably sold the car the and handed the cert. to the new owner to save himself the postage.

    Then he is not an official motor trader/dealer. He is not sending it off as he doesn't want to add himself as another owner on the car. You really should have treated him like a private buyer, put his name and address on the form and you as the seller should have posted it to Shannon.

    Don't have the form now, he has it. I can get a replacement i suppose , whats the exact form i need? Thanks

    You can request a replacement log book for €12, then fill in his name and address on the change of ownership section and send it off to Shannon.

    So suggestion is for OP to download form and send it off to Shannon with dealer's details?

    Not quite. As the guy is not an official motor trader, the OP as still the registered owner will have to download the replacement log book form, get it stamped by the Gardai then go to their local motor tax office along with €12 and they will send it off to Shannon who will send out a new log book to the OP. Then when it arrives fill in the change of ownership part with the name and address of the guy who bought it, then post it to Shannon. Shannon will then issue a new log book out to the guy who bought it.

    So what happens if someone driving it is caught by a Go Safe van?

    If you sell your vehicle to a motor dealer, you have to complete Form RF105 (pdf) which is available from the motor dealer. The completed form should be returned to the Driver and Vehicle Computer Services Division, while the Vehicle Licensing Certificate and Vehicle Registration Certificates (Vehicle Registration Certificate for post-April 2004 vehicles) are given to the motor dealer.

    When selling a vehicle to a motor dealer in either transaction, a valid garage code must be supplied on behalf of the motor dealer. Failure to supply this code will result in the change of ownership being rejected - by either your Motor Tax Office or the Driver and Vehicle Computer Services Division. The motor dealer can only obtain a valid garage code from the Department in Co. Clare by fulfilling strict criteria. (See "Where to apply" for contact information.

    Oh and how i do actually check if im still the registered owner?

    They go to the registered owner of the vehicle unless you can prove someone else was driving the car at the time of the offense and they will go to them.

    And you check the ownership status on the motor tax website.

    Yep, I corrected that in my later post. I don't think according to the OP that the guy is registered as a dealer/motor trader, probably a self employed mechanic who just buys and sells cars frequently.
