    Hi all, if a new neighbour down stream puts in a number of pipes in a river that will not take the water flow in the winter what course of action can one take. I have spoken to him and he has said it may not rain as heavy this winter.

    "down stream" will that affect you?

    Neighbor down river is piping the river.
    Op is concerned that the pipe won’t take the full flow of the river and flood his ground.

    Yep but its down stream so it will probably flood out over the neighbors land first. Most of the piping of streams I've seen tend to get over topped if they blocked so if there is much of a slope then upstream doesn't get that affected. Depends how close the OP's land is. The most annoying thing with piping streams is that they can get blocked up if not regularly maintained.

    I'd get on to fisheries, EPA, OPW and the local council but after having complained about the banks of the river next to us being changed by a neighbor to prevent them flooding which reduced the flow of the river I don't hold out much hope.

    If that’s his attitude,then I’d go to a solicitor pronto,
    You cannot legally, stop or interfere with flowing water,be it a stream or a river.
    If it’s a tributary to a salmon or trout river then he in in deep doodle

    Sorry to jump in here. A neighbour of ours have diverted water, drains I suppose thay used to fill an old water trough of ours. They filled up the channel that had a flat stone to open close flow of water to our trough. Is this something I shoukd ask them to open up again or just try and get someone else to open it. The water used to flow underground along an old passageway to our field.. They would have know what they were doing at the time as they have filled in the last part of the passage way even though there is a right of way there.

    Fellas, these are legal matters, and as such should be dealt with accordingly.Posting them on a public forum is not going to solve them!!

    To take a digger to a river/stream you may need approval from the National Parks, and/or Inland Fisheries Ireland. Both don't have enough man power to monitor all the rivers/streams, they depend on phone calls from the public to let them know if any unauthorized work is taking place.

    Our neighbor downstream won’t clean shores and we’re bavking up because of it.
    It’s a pain but dint want to row over it.
