Siting of a treatment system

    We are sale agreed on a house, and the worry we now have is something our surveyor has highlighted.
    'the siting of the treatment system is contravening with condition 9 of the planning permission as it is within 20 metres of the dwelling. This will require retention.'
    This is the last thing holding up the sale. Our surveyor said it is over the epa distance, which I think he said was 7 or 10 metres. Am I getting to concerned over this?

    The vendor should sort this by way of retention before you purchase the house. This will take approx 15 weeks.

    It's not your job to sort out. This is totally the vendor - if they want you to buy it they fix it.

    Unfortunately this means that someone else who doesn't care and doesnt need a mortgage can take the risk and purchase the non-compliant house.

    This is the biggest amount of money you are likely to ever spend - no risks should be taken. Let your head rule your heart.

    Be aware also that the local authority may charge planning contribution. I had to apply for retention for a small porch that was not compliant when originally built, but would not require PP now. We were selling, and the purchasers solicitor would not let them go ahead without either PP or an €8k drop in the price. From memory the survey and application cost c€600, the planning contributions were nearly €2k (South Dub Co Co).
