Irish Casino Laws

    Hi guys,

Quick one for you on Irish casinos, I know that technically they are illegal to have them open to the public so they get around this by having them as private members clubs which allow them to operate but I had two questions I hope you could help with.

    1. If they are private members clubs do they need a gambling license?
    2. Can this approach be used for online sites? An example would be a betting platform with users become members for a small fee (in return for commission free betting) which then eliminates the need for a license for the operator removing a very large expense from the overheads.

For online gambling, most websites are usually operated from somewhere other than Ireland where the regulatory environment and tax system is more onside. Malta is a specialist in this area. Check out terms and conditions for online betting websites and you will find lots of references to Malta.

Its a highly regulated market in general, and I dont think there is an easy entry (or way to work around the regulations) - especially online.

I don't think your statement above of the law in Ireland above is really correct. The situation is a lot more subtle and nuanced than that.

I don't think a gaming club with a membership fee but no 'rake' (gross profit taken as a proportion of the amount customers play) would really be viable. But maybe there is a model to do this. I think you would need to have a lot of scale.

The cost of a gambling licence isn't just the ticket price of the licence. It's the cost of all the compliance and control activities that go with it. But if you are running a casino of any scale, online or otherwise, you will incur the cost of a lot of this compliance and control anyway.
