Disability Allowance - Cruel Joke

Hello boards people. Listen to this. Twelve months ago (early July 2017) I apply for DA as I was advised by my CWO that I’d qualify. Initially refused in November as expected so I appealed and got accepted 7 weeks ago, 5th of May. My job which was only 20 odd hours to keep something coming in while I awaited response, let me go just before I got accepted. As bad as losing a job feels I was happy that my honest appeal had been upheld. 7 weeks on and I finally get a letter: please send us your p45, statements, all the stuff I originally sent. I’ve sent it in but I just can’t believe it took 7 weeks to tell me they need to means test again. I’m destitute for the past two months and I couldn’t get SWA because they said I should be in payment soon so it’d be a waste of time. Now I don’t know how long they’ll take to see my means are squat, but I can almost taste the fact that I’ll be waiting another few weeks. On top of this my friend got jobseekers within 2 weeks of application. No point in complaining as it won’t do much, but since I’m now out of work, does anyone know if the last 6 months of payments are even assessed against me? Will they affect what I’m entitled to, either with arrears or the weekly payment? They were really nothing, I made maybe 4300 over half a year and my bank in now empty. But I know with these people they’ll use anything possible to delay further and cause more stress. I’m worn down as it is.

I have no experience of DA, but if you were not in employment when you were first assessed, then got a job for 20 hours per week your situation would be seen to have changed. If you were on DA and wanted to get a part time job it would have to be approved.

You apparently were not working when you first applied for DA, so it is not entirely unreasonable that your need for DA might be questioned if you were able to work for 20 hours a week for 6 months in the meantime - were they aware you were working at the time you appealed?

Maybe the best approach would be to go back to SWA while it is being sorted, or at least talk to your CWO.
