Driving Work Vehicle with Tax disc out of date

    Hi Folks,
    Looking for a bit advice here.
    Work for organisation which involves driving of their vehicles at times to collect people who use their service.
    We have just realised that the vehicle is out of Tax since since March and head office say their is a delay with sorting it out and cannot confirm when it will be up to date.
    Worry I and other staff have is that if we are stopped by Garda, could it be us personally who is breaking the law by driving an out of date taxed vehicle and therefore open to fines points of our Licence.
    If so have we a right to not to drive it with fear of disciplinary action by Employer

    You are responsible for ensuring the car is legal in the road.

    With online tax, there is no reason for it not to be taxed by your employer.

    you would be the one facing a fine/points/court etc etc.

    It would be completly reasonable to not drive it until this is resolved.

    Drive it around and bring it to attention of Garda who will be more than happy to seize it on the spot.

    That will sort it out.

    The employer having a delay since March is a joke really.

    You don't get points for no tax, but imagine being stranded on the side of the road with a customer... Strange carry on.

    Edit: To answer your question you as a driver are also responsible the car is taxed, tested and insured and can refuse to drive it until it is resolved without risking disciplinary action.

    If your employer thinks otherwise judges will tell them where to go.

    Tax out of date is a 80 euro fine. No points, or court date. The vehicle could be seized depending on the Guard.

    Thanks for the replies everybody.Good to know that points are deducted for this.
    Everyone stood together today in refusing to drive it untill its tax is up to date.

    Manager did not bat an eyelid and said he would sort it.
