Can my neighbour build over the party wall without our consent?

    He says he can because it is over and not on. He is putting insulation over the party wall. Is there a building regulation or law that I can see to verify if he's right.

    There is a garden wall in the garden that continues up to the main part of the house, he has flashed onto that wall and has fitted insulation onto his extension that over hangs the wall in the garden which is the party wall.

    The boundary wall is there to show the boundary. The boundary doesn't end at the top of the wall, it goes up into the sky and hits the clouds.


    If he's an assh*le about it then treat it like an overhanging tree and break off the bits that overhang your property and hand them back to him with a big smile.

    If he has constructed something that actually overhangs onto your side, it would appear that he is in the wrong. This is assuming that wall is actually party wall and not a wall he built fully on his own side of a previously defined boundary.

    Depends on if the dimensions are external ones or internal ones!

    The ends of the dimension lines will show you what exactly is being dimensioned.
