Certified sick Leave and annual leave days Query

    Hi. This is not really a work problem, more of a query....

    Scenario - one was off work with respiratory illness for about 5 weeks and fully covered by doctors visits, sick certs, socisl welfare certs (unused) etc..

    However, (stupidly on hindsight!), As one was quite ill & not thinking straight, one opted to have this 5 week absence from work covered by annual leave days rather than certified sick days at the time.

    Now, thinking with normal head, and no annual leave days left from now until year end ... Can these annual days legally be changed back to certified sick days? Once documentation etc is produced.

    And advice? TIA!

    It might depend who you work for. If you work in the civil and public service then yes, if you're certified sick while on annual leave you can change those days to sick leave and recoup your annual leave days.

    With other employers, I don't know.

    Yes my ER did that for me. I was on annual leave but sick, got doctor's note and got those days of annual leave back.
    Why not to talk to HR and see what can be done?

    Is sick pay part of your contract? If not, and you allocated your annual leave days to the days you were off, you might need to repay anything you were paid during that time if you want to use the days another time instead. Is it too late to apply to social welfare for illness benefit? Your employer might also be open to you taking unpaid leave later in the year.

    Yes, sick pay would be part of contract. But due to continued bouts of illness over the allowable rolling 4 year window,, all paid sick days had been used up and it was decided to use annual leave days instead of unpaid sick leave.

    In hindsight, that was not so wise...fully expect to repay the organisation for annual leave days if allowed to recategorise them. And hopefully not too late to submit certs for illness benefit, which should have been done in the first instance.
