State Pension (Non Contrib + UK + UK Disability)

    Hi Guys,
    Could someone with the knowledge to decipher the following document please shed some light as I have an 80 year old man in a panic, and for the life of me I don't understand it fully or understand where the department of social have come up with the means test figures of state bank balances which are fictional at best however if i understand it correctly the amounts are ignored due to being under €20000.

    Is there a way I can progress this in such a way to get it restored?, the gentleman in question can't read or write so I will attempt to do the leg work with some guidance, another thing to note he is also paying rent @ €125 weekly not sure if that makes a difference.

    I'll attach documents with all personal data removed.

    If he had no UK pension at all or no other income or savings less then €20000then he would be entitled to €251 non con pension. (That’s €232+€10 as over 80 +€9 living alone, I’m assuming he’s living alone).
    Irish pensions will deduct Every single € of his UK pensions from that amount.
    So for example say he had €100 from UK pensions.
    Then his Irish non con pension would be €151.
    SW will not take his rent or any other outgings into account
    BUT
    If he is paying rent then he needs to get on Cavan coco housing list and apply for a HAP.
    Contact Cavan coco first thing in the morning.

    Incidentally techi you should redact that mans name address and PPSN from that letter if you can .

    He's not living alone per say but is paying rent with lease agreement, I have already done the HAP with Cavan coco which was a nightmare but a work in progress as was his medical card they put him through the ringer to the point the poor man was talking about leaving this plane.

    Appreciate response and guidance welcomed

    The means assessment you linked shows no income from his bank balances, but suggests that he has a weekly income of ~€118 a week from UK sources.

    On the assumption that this is correct then his re-calculated weekly non-contrib Irish pension appears to be correct.

    What grounds have you for wanting to appeal the assessment?

    That's the reason I'm on here I don't know enough about any of it or if he has grounds to appeal, if he doesn't then fine at least I've made an effort but if he does then I need to know best way to approach it. Personally I think he's been treated horribly over the last few weeks and in fact a conversation I had some weeks back with the pensions department indicated they were going to restore his full pension.

    Based on the evidence that he sent to Sligo of his income from the UK, then the amount of NonCon Pension Ireland have awarded to him is absolutely correct.
    He has no grounds for appeal unless for some reason he is no longer getting one or either of the UK pensions.
    It is quite a simple “means test” which must be applied to every applicant in order to be fair to absolutely everyone.

    As per attached documents and please forgive me I dont have a full understanding of there letter as it makes no sense to me. He has his Irish pension and his english pension along with english disability allowance.

    Irish Pension = €207 - Now reduced to €152
    English Pension = £113.65 Per week - Euro €130.06
    Disability Allowance = £57.30 Per week - Euro €65.57

    Total Original Income - €402.63
    Total New Income - €347.63
    Assessment Figure - €195.63

    Not sure if this helps

    Probably best not to tell him, but there may also be an issue of overpayment of his Irish n-c pension if he has been in receipt of both UK pensions for a while.

    As a matter of interest is he getting both the Household Benefits Package and the Fuel Allowance, if not then apply for both; and he may also be eligible for the UK annual fuel allowance.
