M+S tyre marking

So I thought that you couldn't have a tyre with a m+s tyre marking on the same axle as a tyre without any specific marking. But yesterday brought a car for the nct with a tyre with an m+s marking on it that I never noticed. The other tyre didn't have a specific marking.
It wasn't flagged by the nct. Did they just not notice it or ? I know most winter tyres have many more slits on the blocks of the tyre. These ones didn't have those and do just look like regular tyres.

    Legalities and NCT rules aside..

Having 2 different tyres on one axle would send my OCD into overdrive :pac:

If their tyres are as good as their food then you should be fine.

Afair you can't have winter tyre/summer tyre setup within one axle.

However not every tyre marked m+s is winter tyre.

Very likely your m+s is all season probably biased towards summer use (from your description).

I thought you were supposed to have matched tires per axle?
Or is that just best practice rather than NCT requirement?

    It's best practice.

It's also a requirement nearly everywhere Europe except from UK and Ireland.

For nct you can have all 4 different tyres.
However it's not allowed to mix winter/summer tyres within one axle.

The M+S marking is completely useless. There are no law nor rules when the tyre deserves it and manufacturers apply it freely - just to be able to compete for OEM contracts.

M+S has a legal definition but tyres carrying the mark don't have to perform to any standard.
The Three peak Mountain, Snowflake 3PMSF has a legal minimum performance standard so that is the only true indication of a true winter tyre.
