Buying freehold from Dublin City Council

    Hi all,

    I am biying an ex-Dublin corporation house at the moment.

    The property is leasehold and there are only 13 years left on the lease i.e. not bankable unless the vendors buy out the freehold from DCC.

    A motion was passed at the DCC monthly meeting approving the sale. I believe the next step is for a transfer order to issue. Is anyone familar with the process and how long it can take?

    I went sale agreed four months ago and am keen to close.

    With local authorities, it often seems like how long is a piece of string. There is little incentive to deal with the matter efficiently. The staff get paid the same whether they take one year or five years to get the job done.

    The best person to ask is your solicitor but if he can give you an accurate answer, fair play.

    On a lease that old the actual purchase payment to the council is probably a few euro so there is basically no incentive to do it quickly. My brother has started the process on a house he bought without a mortgage so it didn't delay that sale anyway. Fees are going to be many many multiples of the payment!

    I assume you have a solicitor who is dealing with all of this?

    Yes. It is the vendor who is dealing with the DCC aspect though.

    I would strongly advise you keep looking. There has been a large enough increase in prices in the four months since you went sale agreed. You may find yourself gazumped if it takes the vendor a couple more months to complete and the now, more attractive title, makes it easy to flog the property for a few grand more.
