opted out of marketing from mobile provider, still getting contacted

    Hi,

    Just want to discuss this.

    I am currently with a mobile provider and have been opted out of all marketing contact etc. However I have noticed that I have been receiving texts from regarding my bills being due( fair enough) and another aspect about my plan

    I am having an issue regarding other text messages i receive, the are in relation to my plan however there is an error with them, i am being advised i will be charged for an add on which is included in my plan only to receive another text a day or 2 later to say i wont and this has been happening months. I have contacted the provider in january to inform them, they told me it was an error and that i wouldnt be charged(i knew this but would be more annoyed if i was) that they would resolve the error. In feb i receive the same texts again, i contacted them and they told me to go online to opt out of texts etc, i went online and found i was already opted out. I rang them to confirm this and they said this has been the case since i set up my account and unfortuantely there was nothing they could.

    I receive the messages again this month, i tried to log a complaint with the provider and they made it impossible so much that ComReg have taken my complaint.

    My query is im wondering if recieving this text message while i am opted out of contact considered a breach of data protection?

    Please note that once in a while i enter a competiton with the provider and their terms state the following:

    "By entering any competition you agree that (provider) may contact you with updates on (provider) products and/or services via email, SMS, telephone or any other manner. Should you wish to be removed from the contact list, please do not hesitate to contact us."

    Does this term supercede my marketing preferences?

    Also if it does why can i nor a customer service agent opt me out of them when i have contacted the, as advised in the term? The only contact i recieve from the provider is through SMS.

    This thread is for discussion regarding data protection and marketing preferences etc not " just ignore and forget, bigger problems in the world/mountain out of molehill etc"

    I'm not sure I understand this fully. Do the texts about the add-on constitute marketing or are they contractual? Are you allowing them to contact you by text for contract stuff? If not, how do you want them to contact you?

    I know nothing about tech but it sounds like there may be errors in their databases.

    Re entering competitions, I'm not sure, but I doubt that the opt-in in the T&Cs for this should override your general marketing opt-out. I'd imagine they should retain a list of numbers of customers who don't want to be marketed. I'm glad I don't work in marketing.
