I was a delivery driver for a pizza shop and worked for them two times the first time I had a contract the second time I didn't and had to fight for my wages but after leaving the job the second time I received a payment of the same amount to the week previous and the job are asking for it back do I have to give it?

Are you honest, and ethical? If yes, give it back. If no, don't.

I am an honest and ethical person but the issue I'm having with the job is they were constantly late paying me and when I approached them about it each time I was left waiting over a week for my wages and I have kids to feed

You only worked for them two times, must have been a strange relationship if you had to fight both times.

You leave and then they decide to pay you, very weird indeed.

Why did you leave if you have kids to feed?

But you have been paid, correctly, for the work you did?

Now, subsequently, you've been overpaid? Pay it back.

You owe the money pay it back. If you cant afford to feed your kids get a better paid job instead of stealing. Stealing is not a good example for your kids

The first time I worked for them I was there nearly a year and got paid regularly then I left for a while due to health reasons and when I went back then I had to chase them for wages weekly. I left because I got a new job.

Ah ok, it's up to you. Will they persue you for the money? It really depends on how much stress and grief an additional week's wages means to you. Hopefully the new job pays better.
