Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

Car stopped in July 17. No NCT, tax insurance displayed

    Hi
    I have a question
    I was stopped in July 2017 for non display of disks. My car had just failed the Nct which I accept but I had tax and insurance.
    I was stopped, car taken but I produced what I had that day and got car back
    Visual Nct inspection was done.

    I got two fines, no tax and no insurance. I paid these back in August as a guard at station said to or else go to court. I got no fine for Nct but I got a summons yesterday.

    Should I not have had a fine or something sent.

    Aren't you allowed to drive to and from the NCT center with an expired NCT cert?

    No. I believe if the Nct is expired its expired.

    This makes no sense to me.
    You said you had tax and insurance, and you got fines for not having them, and you paid those fines? Why?
    Why were they issued in the first place?

    How long was your NCT expired?
    When did it fail? On a day you were stopped, or before that?

    I went to gards station at time of fines and explained situation. Was told it was up to me , if I paid fines no court but of I didn't pay I would go to court and Nct would be brought up.

    Also find it a long time since offence to get summons with no fine in mean time

    If you had insurance why did you not produce it at the station? The same with the tax?

    There seems to be more to this story tbh.

    You got a fine for no insurance and paid it when you had insurance, why? I thought no insurance was a court summons then fine and points from the judge.

    They have 6 months from the offence to apply for a summons, I've no idea how long till they need to serve it.

    Yes I had tax and insurance. Both were not displayed in car but I brought them certs to both the guard who stopped me and into the station that day.

    I didn't get a receipt from the guards the first time for producing.

    Also, not to get sidetracked, but my question was should I have gotten a fine for the NCT?

    It went right to court summons, I got the fines for Non-Display of tax and insurance.

    At the time you were stopped I believe no nct was a mandatory trip to court (that has now changed iirc)

    It was July 2017.

    So you think it is a trip to court no matter. It is still a fixed offence of 3 points and a fine of 60 euro as per the new FCN, or can judge throw book at me?

    Its minimum 5 or 6 points and a large fine with conviction so far more serious

    Yes. You can drive on the day after a failed test.

    IMHO you cannot drive to the NCT, but this is open to a debate.

    No NCT became a fixed charge penalty on 8th December 2014.

    There is no debate to be made, the exemption of driving to the centre was spcifically repealed from legislation 15 years ago, oddly enough the driving from the NCT after a failure was never removed and is once again included as an exemption in the new 2017 Regulations (which come into effect next month).

    I agree with you - but you know better than me that it is still used to successfully challenge the FPN issued.
