Appealing a decision of the Disciplinary tribunal to the high court

    If you appeal a decision of Disciplinary tribunal against a solicitor to the high court are Appealing purely against Disciplinary tribunal or are you also bringing a case against the solicitor to the high court.

    What locus standi has the complainant have to seek to appeal such a finding ?

    I do not think that such an appeal, even if entertained procedurally, would actually constitute the bringing of a High Court action against the solicitor. That would be a separate matter of complainant v solicitor in civil proceedings with their attendant risks.

    Well sadly as it stands there are currently no regulatory authority to regulate solicitors other than solicitor’s Disciplinary tribunal which is mostly overseen by solicitors and if Disciplinary tribunal choose not to up hold a complaint against one of their colleagues there is then an option to appeal to the high court with in a set time period of couples of weeks.

    Whoever brought the complaint to the Tribunal. Sometimes it is the law society but it can be a former client etc.

    You would be appealing the decision the tribunal came to which mean same circumstances just in higher court, however the onus is on the appealent to prove why they feel the decision of the tribunal is incorrect
