Fixed penalty points - traffic accidents off the public road

    Can I be charged by the Gardaí with hitting/damaging another car in a private car park and can penalty points be applied in that situation.

    For many offences, it is not a matter of who owns the car park, but whether the public has access, whether a fee is paid or not.

    A public place under the Road Traffic Act is

    “public place” means any street, road or other place to which the public have access with vehicles whether as of right or by permission and whether subject to or free of charge;

    So basically anywhere that is open to public access ie not your own driveway.
