Debt Collection & Spouses Property

    Hi

My dad was barred from the family home and has a separate ESB meter in his name only in the granny flat attached that he didn't pay

We obviously have our own meter and account in good standing

What I'm wondering is if there was debt collection issues against the amount he owed say €1,000 can they get an order to make my mam pay seeing as they are married?

My sister and I paid for a new car for her as she is on invalidity pension and are worried that the car might be taken despite it being of way higher value

What about the family home is there anything that they can get against it?

We don't know if we should pay it bit then they keep saying they need to speak to him but we keep saying he isn't here and they refuse to engage.

Might I add they cut off the supply maybe 6 weeks back too

We don't know how these things work, should we pay it in case anything is taken from our mam being his wife like

For some reason they had my mobile down and then when I said I was his son they said they needed to speak to him so we're worried here

There needs to be a court judgement obtained, defaulted and passed to bailiffs before anything is taken, and that would be against the debtor specifically or any shared property - the house possibly in this case, but it's not like a forced sale is even possible.

It is exceedingly rare for judgements to be obtained for amounts less than a few thousand euro due to the court costs involved (although it can and indeed does happen sometimes). Energy firms are more likely to simply disconnect and hold the debt against any future account.
