Fair Deal -schedule of assets query

    Hi all,

    My mother passed away in April last. Prior to that she was resident in a nursing home for three and a half years and was under the fair deal scheme. She didn't avail of the loan facility. We had to provide a schedule of income and assets at the time she moved into the nursing home and did so. Since she passed away the HSE have written to me,as next of kin, requesting a copy of the schedule if assets prepared for the grant of probate by the solicitor.

    Mum basically had only one major asset,her house plus a small amount in the bank and credit union. The house was valued recently for the probate application and there is an increase in the value of €95K between the June 2013 valuation and the most recent one. I'm concerned that this will leave me open to some sort of claim or claw back from the HSE. Can anyone who has experience of this process enlighten me ?

    If she didn't go for the loan I don't think they have any comeback. Houses go up in valuation all the time.

    Thank you. I'm sure that its just some form of cross check to ensure that the original schedule was correct but just that niggly doubt that it might be something else.

    Was her nursing home fees paid by the HSE under the fair Del scheme ?

    Yes. Was just wondering if their request was standard practice

    I'd imagine that you're right. And I'd also suspect that they could get the information from the Probate Office should you refuse to give it to them.

    So, given that you've got nothing to hide, why not arrange to send them along a copy so they can close your late mum's file?

    As a general comment, I'm pleased to know that the HSE is checking up on such things, as I am aware of people who have taken steps to conceal their financial position from the HSE for the purpose of the "Fair Deal" scheme, and it's pleasing to hear that they (or, more accurately, their next of kin) may not after all, have got away with it!

    This is normal practise. They are checking that all assets are disclosed at time of application and valued reasonably.
    The only time I have seen them question the asset list was when the person had received an inheritance between application and death.
    Had to provide all documentation on this asset.

    As already said good to see then checking back to original application.

    Just have a query myself I am in the process for applying for the fair deal scheme for my mam my dad passed recently he left all his assets to mam the will is still in probate would these assets be assessed as income when applying for the fair deal scheme

    Yes, any savings over 36,000 euro will be taken as income.

    Sorry for butting in... but could one of you please explain how one can avail of the Fair Deal scheme and not avail of the loan facility. It was my understanding that if you applied for Fair Deal you were automatically availing of the loan...

    It's the bally ballyness of it that makes it all seem so bally bally.
