Legal advice on adult caution

    Hi all,

    A friend of mine is getting sued by her coworker on basis that she scratched her hand. It's a long story, I'm not going to describe it here, I deem it irrelevant.

    So my friend got a lawyer, and when she was asked to sign adult cushion (that is what my friend says it is called), her lawyer advised against signing it as she is not guilty of doing that.

    Now when she is supposed to go to court for hearing, the Garda who was looking after this case is pregnant and the case is going to postponed by a year until January 2019.

    My friend is leaving Ireland this summer for world travel and she wants to get the case done. She talked to her lawyer to get some alternative, and the lawyer said to sign the adult cushion, since she is leaving Ireland she doesn't care about the company she is currently employed in.

    She is surprised that at first lawyer was against signing the agreement, but now he found out she wants to leave Ireland for travel now he insists on signing it.

    Is there a reason why lawyer changed his stance? Any ideas why? She doesn't care much about her company, she simply doesn't want to give her (coworker) an option to sue for money. If she signs the agreement, she admits to whatever claims are against and opens the road for a claim?

    I assume this is a caution rather than a cushion but thanks for the giggle. If she signs to caution then the criminal side is done, but I don't know what bearing that would have on the civil (being sued) case. If it was at work the company is probably going to be sued as they have deeper pockets.

    All of this is bordering on legal advice I'm neither qualified or able to give so I'm just musing.

    Haha yeah sorry, I could swear I heard cushion, but caution makes more sense. Thanks for answer anyways.

    The lawyers advice has changed because his clients circumstances have. Your friend is not been taken to court by a co-worker put is being prosecuted for a criminal matter by the Irish State. If the matter is heard next January then your friend would have to return for the trial. I assume her solicitor has informed her that a possible solution is to accept the adult caution. Also a conviction for section 3 assault is serious.
