My neighbour is draining his extension onto my property and was wondering if there was any legislation stating that your property must be drained onto your own property? Someone told me there was but I cannot find it.

    Did they require planning?
Planning conditions usually state that the works are drained within the subject site so you could report to Planning enforcement then.

If not, then it may be a civil issue between you and your neighbor or possibly a building regulation issue?

Well he has permission but the whole thing is gone to An Bord Pleanala. He is a bit of an idiot, he does things he doesn't have permission for. For example he has put 4 inch insulation on the exterior which is on our party wall, he said he would never build on the wall. He likes to twist his words and doesn't like someone disapprove of what he wants. It seems like we are the first people to go against and not back done and he doesn't like that. I was just wondering if there was legislation to get him ( you would do the same if saw what he does). He was around the corner and fell out with all the neighbors because of what he did there too. He put a balcony on top of a single storey extension with no permission. I would give his and his company's name but I don't want to shame him publicly. I hope there's something because he will do one thing wrong and it will cause his own down fall.

Your post comes across as a rant. What he has done in the past has no bearing on your situation.
If you mean, his roof is draining onto your side, then he is certainly wrong and you can insist that he alters that.
He should have no roof overhang or guttering or drainage coming down on your side of the fence

Sorry about the rant he just really frustrates me. I'm assuming there's no legislation, I looked through the Drainage part of Building Regulations briefly and couldn't find anything clear. If we ask and says he won't what would I do, go to enforcement?

What would happen if you did work on your property that just co-incidentally blocked the drain?

This is a different question on something different but building regulations. Can external insulation board be left unfinished, for example no plaster on it. It is made of some of polystyrene material. I assume it's fire retardant but I can't be sure.

Get legal advice. He has no rights over your property and has no right to locate anything on your property or cause anything to flow of to your property.
Firstly, ensure that the boundary is correct then get solicitor to contact him to instruct to remove offending item and any runoff etc from your property.

It is a partial drain for water off our extension and he conveniently does the same on his side. The drain is completely on our side also.

report to the planning authority. Engage a local Arch/eng to prepare a report and engage a solicitor. And leave the personal stuff out of it, if you can’t, move house.
