Received P45 instead of P60 in 2018

    Hi all,

I have been working at a company for 6 years and in January suddenly instead of my P60 my employer sent me P45 (he didn`t fire me or anything)
He told me that he sent the P45 because he transferred me to his newly registered company, but I still work at the same place and I was not told about this change. The only thing he told beforehand was that on my payslip will show a different company name and that was all.
Now on revenue`s website it shows up as I have started a new job basically.
I will not agree of this and if anyone can help by letting me know:
    1. Can he just simply transfer me to a new company and break the continuity of my years worked without my consent?
    2. What are my options in this situation, as I don`t want a P45, I need my P60?
    3. P45 indicates that my employment has ended, how can I make him to undo this?

    Thanks

This sounds very dodgy indeed. I’d look into your rights. I’m not sure where entirely. You may be entitled to redundancy?
I worked for a franchise in the same building for 18 years. 4 different owners. The last one was forced into liquidation by the franchise operators. I got my18 years. We actually thought we where going to be made redundant and all employed again as it opened again 3 days later.
You need to find out will your time be carried over or can you claim redundancy now?

Yes, sounds dodgy to me too, especially because there are 10 employees that were not affected, I am the only one who has been transferred to the "new company" which I was not told about in advance, he just simply changed everything with the Tax Office without me.

You need to arm yourself with the correct information. Then have a meeting with him. Maybe start with citizens information maybe even a work related solicitor. There is a very good chance you are entitled to redundancy.

Thanks for the advice, I will contact citizen information and make an appointment, hopefully I will get this sorted with their help.
    Thanks
