Received P45 instead of P60 in new year

    Hi all,

    I have been working at a company for 6 years and in January suddenly instead of my P60 my employer sent me P45 (he didn`t fire me or anything)
    He told me that he sent the P45 because he transferred me to his newly registered company, but I still work at the same place and I was not told about this change. The only thing he told beforehand was that on my payslip will show a different company name and that was all.
    Now on revenue`s website it shows up as I have started a new job basically.
    I will not agree of this and if anyone can help by letting me know:
    1. Can he just simply transfer me to a new company and break the continuity of my years worked without my consent?
    2. What are my options in this situation, as I don`t want a P45, I need my P60?
    3. P45 indicates that my employment has ended, how can I make him to undo this?

    I'd discuss it with an Employment Solicitor if I were you.

    You are still entitled to a P60 regardless. Demand it.

    First thoughts are if he closed down would you be entitled to redundancy for those years in a different company?

    You are still entitled to a P60 regardless. Demand it.

    The question is, was the OP transferred before or after the 1st of January?

    It has happened to me several times and it may be nothing to worry about. The last was when the accounting practice I worked for was incorporated and ‘sold’ to a limited company run by the same Partners. Your employment has more than likely transferred to the new company without a break in service. If he ever tried to treat it as a new employment then he’d get a swift telling off in court.

    It is probably a more appropriate forum and no need to have 2 identical threads.

    But yes as others have said, talk to an employment solicitor to be sure about where you stand.

    Thanks for the answers. I will definitely talk to an employment solicitor as soon as I can, but that can take few days to get through one and I want to take the correct steps when speaking to my employer tomorrow.
    On the revenue`s website it shows that I started the employment on 1.1.2018.
    Also bothers me that I was the only one that had those changes and no one else of my colleagues.
