Keys in the ignition.

    This is just a theoretical question.

    Scenario 1.

    Policyholder leaves keys in the ignition whilst he gets out of car to pay for petrol.

    Thief steals car.

    Scenario 2.

    Policyholder stopped at red traffic light. Obviously, keys are in the ignition.

    Thief steals car at gun point whilst the keys are still in the ignition.


    What are your views on the insurer's liability under the motor policy ?

    No liability will exist in scenario 1.

    There is likely an unattended vehicle condition in the policy wording.

    Liability will exist in scenario two as it's a forcible/violent theft.

    Scenario 1 claim would be declined if the policy specifically excludes it. If it's not specifically excluded in the policy you would have to pay it. I assume they all exclude it at this stage?

    Scenario 2 should be settled quickly and as empathetically as possible. Theft by violent force.

    are you talking the Insurers liability to the Policyholder, or to potential Third Parties?

    I was thinking specifically of the insurer's contractual liability to the policyholder.
