BCMS change from assigned certified to opt out

    Hello

    Just a query regarding a new build that started Feb 2015. At the time there was no choice to opt out of the assigned certified process.

    The build took quite a while
    We have completed and paid for 3/5 of the inspection phases. Base/blocks/roof.

    We could still contact the assigned certifier to complete the other 2 phases. We have been living in the house over a year now and all is fine.

    Can I opt out of the rest of this process now. Cost to complete the rest is €2500. Don't really see the point...

    If I can,, how do I go about opting out now ?

    You can't opt out once it started as an "opt-in" - there is no way of doing so. Anyone who started their house in early 2015 is in the same boat.

    This is what is published on a county council website

    Change from AC to Opt Out (AC =Assigned Certifier)
    • Popular immediately after Opt Out measures were introduced in 2015
    • Partial certificate of completion required if work commenced
    • Often does not come to the attention of the BCA unless there is a dispute

    What would you think of this ?

    It appears to say such a process was allowed at a point in at least one council area. I stand corrected - I have never seen or heard of such a process before and I am unaware of any statutory footing that allows it.

    If it's on your Local Authority website then there's nothing to stop you trying to avail of it!


    I have absolutely no idea wtf they are getting at with this line:

    You cannot opt out now. In order to opt out, you need to lodge a new Commencement Notice. You cannot lodge a Commencement Notice as works have already commenced.

    Can you link what county council has this printed on their site please as it seems to be a clear breach of the Building Regulations.
