Who to take to small claims court

    Can any of you guys settle a friendly argument a number of us have been having today over lunch ?

    One of the lads father boughtva hearing aid from a well know supplier.

    He is eligible for the 500 euro grant from the government which is payable by the vendor whom in turn claim it back from the government.

    The vendor for some reason has tried 3 times to transfer the cash to guys account after he supplied them with the iban and bic numbers.
    None of the transfers reached his account and the vendor had been able to recoup one of the amounts back and are actively looking to do the same with the other amounts.

    The issue is that the guy who bought the hearing aid has been given the runaround since early December by this company whilst they mess about with their failedbank transfers.
    Multiple calls, multiple messages left with no call back and even a call in in person in the hope of getting it sorted.

    2 weeks ago after more phonecalls they told him if he brought a bank statement to them showing that he never received any monies off them they would issue him a cheque for the amount owed.

    He done this and was told they would give the statement to the branch director who would authorise the cheque, after 2 weeks no cheque, no calls just the runaround again.

    He has been advised to take this company to the small claims court to finally get it resolved.

    The question is is it the director he brings to court or the business itself ?

    Im saying the director, his son says the business and my mate says it doesnt matter !!!

    Which of us is right ???
