Clamping signs and notices

    I know, another clamping thread...

But I've searched and can't find anything about this particular situation.

I live in an apartment complex with permit parking. I have a permit, but it wasnt clearly displayed at the time, and I got clamped.

I've contacted the clamping company but theyre not budging yet.

The thing is, the new clamping laws set the max release fee at €100, and towing fee at €50. But the signs list a release of €120, and towing at €350.
Also, the laws say the notice on your car has to state the time and date that the car was clamped, which theirs doesn't.

Do the non-conforming signs and notice give me any legal standing to dispute this? Also the fact that I've paid for a permit specifically so that they wouldn't clamp me.

I bought a lock pick set recently so I'll give that a go, but I don't hold much hope for that!

Boards cannot give legal advice but I have pushed this to Legal Discussion as they may help you with local parking laws and if these laws apply to your clamper.

Was it council or a private clamper that did it?

    Thanks for moving it.

It's a private company. Unfortunately I've never been able to make contact with the management company for the complex, their phone number comes back as invalid.

Still awaiting a reply from the company regarding what their release fee is. The signage also says the fee is based on each 24 hour period, but I don't see how this works if they don't notify you of when the car was clamped.

Had a go with the lock picks, but it's an unusual type of lock. One which the internet says is known for being near impossible to pick!

Private Clamping is not lawful or regulated.

Private Clamping is not lawful or regulated.

    That's not true anymore
The Vehicle Clamping Act 2015 came into full effect on 1st October 2017. The Act provides for the regulation by the NTA of vehicle clamping activities in both statutory and non-statutory (privately-owned) clamping places throughout the State and also contains some other legislative provisions relating to clamping.
