No longer a protected structure?

    Hi, what is the process by which a building is removed of the category of protected structure? An old building near us had been protected- one day we saw massive work/ partial demolition going on to it, no planning, and upon checking saw that it was suddenly not on the register it had always been on previously. I'm interested in how that can be arranged, and to what extent is it subjective or are there a set of criteria to be kept? Thanks

    Thank you. I wasn't able to find any details about removing a property- is this just at their discretion? It's hard to see why a building that merits protection in one year would not anymore in the following.

    It would require a record of why it was deleted from the protected structure list. Call the planning section and see can you get any joy. Failing that write in, failing that a FOI request. Also check the NIAH website, select county and put in townland to check if the department have their record of it.

    It may still have been illegal to demolish - you need PP to demolish (a) any residential property or (b) any other building that is more than 100m2. Make a complaint to Planning Enforcement regarding the demolition without PP.

    The register of protected structures is revised from time to time. Typically it would have a major review when the city/county development plan is being revised and during the duration of the plan on request. Reasons for deletion would be destruction of the building (e.g. by fire), planning permission given for its demolition (e.g. Collinstown House was demolished as part of the construction of Terminal 2 in Dublin Airport) or a request from the owner to remove it.
