Lease still active in UK on van for sale in Ireland

    Hi folks,
    I gave a deposit on a UK imported commercial 15 van last sat 20th. I have two friends in the car trade and one of them did the SIMI check on it which showed an active lease in the UK. I phoned the lease company myself and they confirmed the lease is current and active. I then informed the seller(who has a good stock of these vans/but just a small apparently limited company). He said it takes time for these things to go through in the UK. I informed him on the following Friday 26th (yesterday evening) that its still active and not comfortable about paying him in full for the van until the lease has ceased. He has put van through DOE and registered it in my name. He got quiet vocal spouting that's he's not a cowboy outfit and that he'd sell the van to which I replied that I have a deposit on it. He informed me that he actually buys them from the leasing company and that it would be sorted.
    I'm thinking of holding tough until its clear on the check before I pay him, anyone come across this kind of story before?

    All depends on the deposit and how much you can afford to lose. North south east or west? One operation here down south at the same crack.

    I'm down South, in Co. Cork.  When I spoke to him I told him I'm not refusing to take the van but he'll have to sort it..that's when he went off on the rant..

    Leasing company's and banks can be notoriously slow at taking things off theor books but i think you are right to demand its all clear officially before taking delivery of the van. The dealer should be pushing them for confirmation of this.

    I take it you are not financing the van?

    I'm not financing it through a loan against the van, I took a personal loan so that I can shorten the term if I can afford to.
    It could be just admin not gone through but that gives me no guarantees, he said he'd give me a letter stating that I wouldn't be liable but think that wouldn't be worth the paper it's written on if leasing company come looking for van..
    Its 8 grand I can't afford to pay twice thoughðŸ˜

    The other thing that had me a bit sceptical is that he is advertising as one particular Ltd company, but after I'd given deposit he gave me a different Ltd motor company name to make the bank draught out to...I'm a bit stumped tbh

    Story sounds legit but I've read a good few horror stories about people after buying cars that were still in finance deals where some of the outcomes ended in seizures of the vehicle, no ifs or buts..
    @Colm_mcm...good idea ..might ask him for same..

    Hi OP, plenty of vans out there. You have a legitimate concern and if it's not being addressed to your satisfaction get your deposit back and walk away.

    If the seller is as confident it will be 'sorted' like he is telling you then he has no need to be concerned and should wait until all is cleared with the finance compnay before expecting you to pay him.

    Do not take it until you have proof it is sorted. You don't need the hassle, risk or emotional cost of uncertainty...

    Often, not always, people who get angry when you confront them have something to hide because your concern is a very rational and ordinary one and he should be sympathetic to you having it. Insist he proves it is in the clear - or at least - thats what I would do.

    Has he got the V5 for the van?If he has there should be no problem.If you lease a car or van in the UK they don't give you the V5,The keep it until the lease is up or sold on.So if he has the V5 that means the lease company sold the van.

    I'm not familiar with the registration process here when bringing in a vehicle from UK but I'm presuming he would need it to register the van here in my name, which he said he has done, he has also given me the Irish Reg (num plate) for the van, so guess if I get letter from him stating no liability on lease situation I'll just have to accept it.. At least I'd have something if any problems show up down the line..

    Lease company's don't usually sell directly to the public,The sell through the like's of Bca auctions.Ask him to look at receipt for van let him block out the price he payed for it if he like's.

    After having a read on the Revenue Commisaires website, he couldn't register it here without the V5 log, the van was def on a lease with Leaseplan UK so they would be holding the logbook until sale..tbh I don't want to leave it go as I have been looking to buy with 2 to 3 months. I'll keep ye updated..
