Grant of Probate

    Hi Guys,

    Was hoping someone may be able to shed some light on the grant of probate.

    Our application for probate was recently approved appointing executors to the estate. As of yet total assets/liabilities of the deceased have not been disclosed to all parties.

    Could someone advise if I were to visit the probate office, could I pay for a copy of the now approved grant of probate application over the counter?

    Can you clarify exactly what you mean by 'our application'? Are you one of the executors?

    You can pay for a copy of the will but by the sound of it, what you are really looking for is a copy of the revenue affidavit which the executors are required to make and which outlines an inventory of the assets. I'm not sure if you can get (or are even entitled to get) a copy of this.

    Only the executors would see this.

    Total assets and liabilities will be shown in the estate accounts, but they are made up at the end of the process, not the beginning.

    Unless you are entitled to a share in the estate, you have no legitimate interest in knowing what the total assets and liabilities are. If all that Auntie May has left you is 500 euro plus her second-best statue of the Infant Samuel at Prayer, well, that's all you have any interest in. It's only the residuary legatees - the people who get what's left over - who get to see the whole picture.

    Thanks Guys, in this instance I am connected to the process as a creditor to the estate, I realise it is the obligation of the executors to discharge all debts, although I have my reservations as to the overall debt quantum and asset portfolio of the deceased. I have little to no interest in visibility over the last will and testament and who’s claiming what, although the revenue affidavit would she’d some light on the whole situation.
