Hi, we're looking to let out an apartment, its located over our shop. Our solicitor advises us to obtain a separate folio number (separate from the shop) for the apartment if we decide to proceed.
    Is that necessary?
    TIA

Not really a construction or planning question.

Are you looking for a second legal opinion?

What is the solicitor's reason? It might not be legally mandatory but I can think of a couple of reasons why it might be prudent. Sounds like he/she is looking after your interests on this one - I'm sure they'd have no problem explaining why!

I'm not a solicitor though so I won't try to second guess.

You won't get legal advice anywhere on boards, including the Legal forum. Particularly when you've got a solicitor engaged already.
