Lost title deeds

    I redeemed my mortgage in 2007 and assumed that the title deeds to my home would be forwarded to my solicitor, I also assumed that he would keep them in my file for me.

    However, I was in contact with him recently and he assured me he does not have them nor did he ever request or receive them and that if he did he would have sent them to me.

    So I contacted the bank and they said they were sent to my solicitor when the mortgage was redeemed. I asked did they have proof of this and they said no 'An Post only keep records for 12 months'. They also said they have no signed acknowledgement that I assume would have been placed on my file for their own records.

    So despite exhaustive searches by both parties they haven't shown up and each are blaming the other and effectively denying liability.

    I am now at the stage where I'm finished going around in circles and have engaged a new solicitor to start the process of reconstruction of my properties title.

    So my question is, who is liable for the cost of this? The bank were the last people to have them, they have no proof they were delivered to my solicitor so I'm guessing it's them.

    Any advice greatly appreciated.

    However, you should put this query to your new solicitor.
