Commercial tax on 5 seater /company director

    Evening
    Am looking for some clarity as there seems to be quite a bit of conflicting information on here.
    I'm a director or a company and my job often entails visiting and evaluating commercial and agricultural properties.
    I don't carry any work materials however will sometimes go off road etc due to the job.
    Am I entitled to use a €333 taxed commercial vehicle such as a 5 seat LR Discovery ??
    Don't want to do anything hooky so am I straight up entitled to do so??

    Rear seats need to be removed by an approved company. Photos of before and after along with various reports are needed.

    I'd say you can. I think you can get a letter from the company saying you need the commercial for work however technically you won't be able to carry passengers unless it's work related. Also the company could buy it and claim the vat back if vat registered however crewcabs are classed as passenger vehicle for bik. But not sure how that would work wether you would be claiming bin or not. If vat registered the vat number should allow you tax it as commercial. I have seen some second hand for sale with receipts at both the 333 tax rate and the 1200 tax rate so not exactly sure on the company side of things. Perhaps your accountant would know for sure?

    You can claim the vat back on the purchase price and tax it at commercial rate but you still need to pay Bik. I do know alot of lads that have them and claim there on call 24/7 and avoid it though
