Jeweller lost my Watch

    As it said gave my pretty expensive watch to an authorised dealer to get it serviced, watch came back to them but when I went to collect it they could not find it. They rang today saying it was missing and could I call in to discuss what to do now.
    If it doesn't show up what are my rights.

    They should replace it/compensate you - or find it asap.
    Presume you have a docket for the item.

    IMHO the jewellers are bailees for reward.
    Therefore, they are obliged to deliver up your property to you or to explain why they cannot do so.

    If they cannot return the property they should indemnify you. Indemnity does not necessarily mean monetary compensation if, for example, they can give you a replacement watch of exactly the same specification thus placing you in the position that you were in when you handed it in.

    To be honest I just want my watch back, I have it for 20 years and I am quiet attached to it, money I don't want and to be honest the new model I don't like, I will see what the say next week.

    Perfectly understandable.

    My inner cynic wonders if the watch was conveniently "disappeared" by a member of staff. If you get no satisfaction next week tell the manager that you will, of course, be reporting this to the Gardaí who will hopefully be in contact with them shortly. They might look a bit harder as Garda attention is not always welcome.

    You might usefully check your insurance policy to see if there is cover for goods temporarily outside the house, or all risks insurance or such like. If so, I would expect this to be covered as an insured peril such as loss or even theft. You may need to fall back on your insurers for indemnity if the jeweller disclaims liability.

    If you have to claim for the loss from your insurers they should then fund any claim for recovery from the jeweller by way of the exercise of subrogation rights. This might even be a Small Claims Court case as OP appears to have been a consumer in a contract with the jeweller.

    P.S. If you ever get the watch back be sure to take several photographs of it and any other valuable jewellery for future reference. I enquired last year from two reputable jewellers about valuations for several rings and asked them to provide photographs that would identify each item to which each valuation referred. They said that they didn't do that so I found a jeweller who did.

    They are one of the biggest jewellers in the country and the owner rang me, I suspect it might have walked out with a member of their staff, they won't want to muc bad publicity, I have the box it came in ,all it's paper work and even the till receipt , I will see what they say but I looking here to see what my options are, could I demand a new one or am only entitled to the same one back or do they give me cash. I have looked on line and older models are worth as much as a new one.

    you are entitled to be put back in the same position you were in before you gave them your watch. if they are paying you compensation it should for whatever the watch is worth. Be prepared to get a couple of valuations from different jewelers. They cant just give you what THEY think it is worth.
