    I just received a summons for court about speeding. I was trying to sell my car when the van caught the car but it was the other driver. How would I go about telling the judge that as the new buyer didn't buy the car so I still have it. Would I still get the points & have to pay the fine?

    Don't the vans take pictures of the drivers? Dunno, but I thought that was the case.

    They changed it so only the back of the car gets photographed

    Don't you have the option to put the correct driver's license number down on the fine if the registered owner wasn't driving at the time of the offense?

    Don't even know the licence number as I was trying to sell the car & ya wouldn't ask for that Yano,

    Unless you can get hold of the actual driver's license details to nominate them to take the points, I'm not sure what options you have.

    Can you get the driver at the time summoned legally to appear then question him on the stand to show you were not driving ?

    You're just going to have to take the hit and put it down to experience. I know you are genuine but if they let you off with it with out the actual offender what's to stop every tom dick and Harry from using a similar excuse

    Your only hope is to prove that you were not driving.
    You don't need to point who was driving, or have his details.
    It's enough in court if you can prove that it wasn't you driving.

    Were you in the car with the buyer?
    If so, I would ask gosafe to make photo available to you, and I assume a photo of you in the passenger seat would be enough of a proof.

    Pity that Ireland is probably one of the very few (if not only one) countries in the world, where is cases like that, you (as a vehicle owner) are assumed to be guilty and have to prove your innocence.

    In most places you have to be proven guilty to be prosecuted, not opposite.
