Grandaunt - Group B or C?

    Hi Folks,

    This is in relation to CAT. 


    A long time ago I received money from my grandaunt. I have now received a small amount from my granny. The lawyer is saying that a grandaunt is in the same group as my granny (group B) and therefore I must pay tax as I have already exhausted my limit. From my memory and research, I believe a grandaunt is group C (I am not her lineal descendant). 


    Does anyone know which one is correct? Also, to see documentation on this old transaction, would revenue be able to help and tell me which was applied back then? It was over a decade ago.

    I think you are correct. A grand-aunt - I presume, the sister of one of your grandparents - is in group C.

    The aggregation rules haven't changes since 2001, so even if the first inheritance was "over a decade ago" it may well still have been treated under the same rules as apply today.

    At the time, it would have made no difference whether your grand-aunt was treated as being in group B or group C; either way there would have been no CAT due. So I doubt that paperwork from that time, even if you could dig it up, will devote much attention to the question of which group she was in.
