    It's not quite clear what's happening here.

    Is he arguing that he has commenced the first permission? If so, the commencement notice will state exactly what permission he is commencing. He also obviously can only carry out works pertaining to that permission.

    My neighbour has applied for a Commencement Notice supposedly and says he got one. But the planning has been appealed to An Bord Pleanala. He has started working and enforcement came out and said he has a Commencement Notice. There was previous planning permission granted before he bought the property and he said he can start work on the old house( his plans include a second house added on). Is there anything I can do? Is there any legislation?

    It sounds like a complicated situation to answer based on the info.

    Commencement notices are lodged online and are validated within a few days.
    What Council area is the site in? Some are quicker than others.

    Also, if there is a series of Planning applications on the site and only one of them has been appealed then technically he can commence on one of the other applications but the works would obviously have to correspond to that application.

    If Planning Enforcement has been out, you can be assured that if there was anything wrong they would ensure complince is met or the owner would have an enforcement notice on the property.

    What did Planning Enforcement say if they have already been on site?

    Id suggest that if you think they are pulling a fast one, search for hos commencement notice on bcms system. This will refer to the related planning permission. Get a copy of that planning file. If the works on site go beyond what is granted, contact building control.
