Broken goods returned

    Hello

    I recently sold an item on adverts and the buyer contacted me after 4 days and told me there was an issue with it,a broken pin.He told me he had brought it to a retailer that had confirmed that.

    I buy and sell a few things so I was unsure of what item it was and when I had gotten it back the pin was broken but then I checked my photos .The item was not damaged in anyway when it was sent out.

    Iv asked for the contact details of the it retailer he used to confirm the damage and he will not provide the details.

    Is there anything I can do about this ?

    You could ignore him, wasn't this a private sale?

    Sounds like they've broken the pin, why didn't they call you straight away if there was an issue.

    Also, hoping the item wasn't a hand grenade! :D

    The issue is I have taken the item back and am only getting around to looking at it now

    Why do you want to know the retailers details? Is the pin broken or not? If it's not broken and you have it in your possession, just cancel the sale and sell it again, it's hassle and youll lose something, but that's a sellers life unfortunately.

    He fudged the install, damaged a socket pin, then blamed you by the sound of it. But you accepted it, so theres nothing to be done now.

    He pins defiantly broken.The claims to have taken it to a it shop to get checked,I think hes lying about that too and if I can catch him on that that would it help my case against him ?

    Even with the time stamped photos I have showing the board undamaged ?

    Do you have the item in your possession now?

    What do you think he’s gonna do? Give you the money back again for it to buy it off you again?

    It was a private sale. You shouldn’t have taken the item back off him.

    As this is legal discussion hypothetically you can take the guy to court, whether it's worth it or you can even avail of the Small Claims Procedure is something you'd have to check out but I'd suggest it's not worth it on either front. Poor feedback on adverts and next time don't take things back; shame to say it but that's life.

    Small claims court cannot be used by a business where the respondent is a private consumer.

    What you're suggesting is a charter for scam artists - advertise goods in 'perfect working order', ship them broken junk and they can p1ss off.

    'Caveat emptor' may apply in the case of the private sale of a secondhand car but even a private buyer is entitled to get the goods in working order - 'fit for the purpose' and that sort of thing.

    Not suggesting for a second that the OP shipped defective goods to his customer but in general terms, you cannot send someone a broken item and then simply wash your hands of the matter when they had a reasonable expectation that the item that would perform a specific purpose.

    All your photographs prove is that you had an undamaged item of that type at that time. It doesn't prove you didn't also have a damaged one.

    One possibility is that it could have been damaged in the post and that you posted an undamaged item, but the buyer received a damaged item. Unfortunately, you have no way of proving whether that happened, or if you have a dishonest buyer.

    I've a non working motherboard in a PC here on the desk in front of me. I'm waiting for an identical second hand replacement thats guaranteed tested (can of worms but not my point here) from an ebay seller.

    I could (but won't) use the replacement and tell the seller it doesn't work and send back my broken one.

    Pictures may not prove much but as a seller I always mark the item in someway so I know if a buyer is trying that trick. I doubt that would help me much in dispute resolution but there is some consolation in having proof you are dealing with a swindler.

    btw and off topic, what sort of fat fingered fool manages to damage a pin on a motherboard CPU socket? there is no need to touch the pins ever. I've must have fitted/ swapped hundreds of CPU's and even with heat sinks that have been near welded to the CPU I've never damaged a pin. However I hope the OP shipped the motherboard with either a cover for the socket or an old CPU to stop the pins getting damaged in transit.

    To be honest I think he broke it on purpose .Hes a buyer and seller of systems ,It was one single pin with zero damage anywhere else to the socket.Hes reasons why ,I dont know maybe it has incompatible with the rest of his parts.
    All I know it was 100% when it went out to him.Tested,benched and photoed.It comes back with a broken pin.Nothing more I can do.Really annoying that he would do that.I would have no issues with him sending it back if it didn't match.At least then I could have sold it on to someone else.
