Paypal dispute and possible decoy tracking number?

    I made an order from a Spanish shop on the 19th of November.

    A week later, I received no update and the order still said "processing" on the website so I emailed them to enquire but they never answered.

    A few days later, I tried again and there was still no answer so I sent a message through their own website but that was also ignored.

    I started to worry so I checked their facebook page and saw lots of very bad reviews, mostly about taking weeks to receive orders and no communication from the shop. I sent them a message on facebook, since I could see they were responding to people there. They answered to say they had sent the order and that it would be with me by the end of the week.

    I waited until the end of the week - still nothing, so I sent another facebook message, which was ignored.

    Next thing, I realised that their facebook page had been deleted. That was obviously suspicious so I decided it was time to open a paypal dispute.

    As soon as I opened the case and contacted them through paypal, they answered to say the parcel was lost and that they had sent a "second" parcel. They gave me a convoluted story, which there is no need to go into here.

    They said there were a couple of items not in stock anymore and that they would refund me for those items. They were quite pushy about telling me to close the paypal dispute so they could issue a partial refund for the "missing items". I told them I'd prefer to wait until I receive any items at all before I close the dispute.

    Anyway, they gave me a tracking number for the "new" parcel. (I also asked them for tracking for the first "lost" one but they will still not provide it.)

    So the supposed second parcel was registered with Correos (Spanish post) on the 7th of December and has not gone anywhere since. I know it's possible to print a shipping label and not actually hand any parcel in so I'm wondering if that's what they have done? The tracking does show that the parcel was "admitido" but I wonder if that might mean it was accepted into the system digitally, rather than accepted physically? Does anyone speak Spanish or know anything about their tracking system?

    Also, now they are fighting my dispute on paypal with their tracking number as "proof" that the parcel is on the way. If I don't escalate it before the 25th of December the case will be closed. I obviously won't let that happen and I'll escalate it if I have to but do you think there is any chance the parcel is actually going to come? If not, is there a chance paypal will side with them with their "proof"?

    You always have comeback.

    PayPal can decide after x length of time if the parcel doesn't show as delivered to issue a refund and take the money from the seller.

    If you need further defence to it you can ask for an affadavit form to fill in.

    I've done this for a US seller. One item in parcel, that should have two. PayPal intially found against my claim as something was delivered but I fought and fought and got the affadavit form and a partial refund.

    Go to PayPal, go to the claim and ESCALATE to a claim. If you can't do it now it will tell you when you can with a specific time and date.

    They normally allow time to have the back and forth first with each other.

    PS. Spanish post isn't fast either. Could be on the way for all you know, tracking number doesn't necessarily mean tracked at all. Just a parcel identifier.

    Yeah, it was updated this morning. Obviously the Spanish tracking is not very efficient. Hopefully I'll get the order after all.
