Bins and Illegal Dumping

    Hello,

    Looking for some advice. Bought a property two years ago. Love it and no problems bar bins. So as part of you management fee our bins are included. There is a common bin shed. But the lock is broken. Basically our bin shed is the local free waste disposal. Dozen or so cars daily pull in and dump their rubbish. Management company told us to call the county council but they say because it is private property nothing they can do. At annual meeting management company reported the illegal dumping is cost us ~€6000 a year. Have asked for lock to be fixed, but no sign of this. Have asked for electric gates to be fixed also no sign of this. Final straw tonight, was seeing the owner of the management company pull in tonight and unload his waste.

    What to do? Just ignore? Need some advice.

    I would be asking serious questions of the management company. They are prepared to pay €6,000 to clear up the waste instead of fixing the lock to prevent it.

    Who got the €6,000 ? Are there any ties to the management company ?

    The management rep that dumped his own rubbish there needs to be challenged on it at the next meeting in front of everybody.

    Thanks for the reply. Next meeting is 10months the away. Also he is the owner/director of the management company. Going to talk to three of my neighbours. Can we ask for an EGM?

    The money was to depose of the illegal waste, larger items like mattresses, furniture, building waste ( two builders regularly dump waste).

    A management company is the residents. So why aren't the residents upset about this and taking action?

    The estate is run by a private management company. We have been in contact with the management company, voicing our issues with it. But nothing is happening.

    Everyone in the development will own a share of the management company. The management company can appoint a managing agent to carry out its work. Sounds like this guy is head of the managing agent.

    The MUD act sets out your rights (Google it). First thing to do is force an EGM to change the management agent. Vote in new directors as well to get a handle on what is going on.

    I'd also be threatening the management agent with prosecution if you catch him again. A quick video on your mobile phone should be enough

    Thanks for the information. Looked up the act there. I'll be contacting him tomorrow about it. Have it on my phone. No wonder he doesn't want the bin door sorted.

    it's pretty common that owners of rented properties will add to the bins.
    Not sure what can be done as even if the lock is replaced the owners will have a key.

    If they own the properties then surely they are in their right to use the bins as they are the ones who pay the property management fees.

    Bringing waste into a development for the purpose of disposal is asking for the bins to be abused.

    There would also be issues with capacity as owners are going to fill up their car/van so as to minimise their efforts.

    and of course the owner occupiers are subsidising the investors waste disposal.

    Wonder what would happen if a resident parked a car in front of the shed preventing access ,
    Would the management company be quick enough to do something

    The management company needs to put on a new lock or a new entry lock which has a pin,
    this will cost less than 6k , maybe 200 euro.
    the point of a company is to fix basic issues like door locks etc
    otherwise why are you paying service charges.
    they need to have a company on call to fix doors ,locks etc.
