Horses - Damage

    Long story short, horse owner is trying to keep horse's in an area that is not secured or at very least they need to fix areas where the horses are escaping, horses keep getting out and seem to love my garden.

    Garden is now cut up full of holes as is a few neighbors gardens.

    The land owner has said that the horses are not theirs but would try and get in contact with the owners but the horses are out again and been wander about the area for the last week.

    I have secured the horses in my own field for now just to keep them off the road and for someone to come claim them.

    Albeit I am annoyed at the shape of my lawn but it is something I can fix.
    However when the owners do come claim the horses I want to be clear on liability.

    My son who is 3 ran out when he saw the horse, which spooked the horse it rared up and bolted. Could of been a dangerous situation.

    Just wondering what the laws are around owning horses and damaged causes by horses.

    Again I have no intention to perusing any damages I just want to be clear with the owner that this needs to resolved as they have already caused substantial damage and having horses loose like this is dangerous.

    Your local council may have horse bye-laws and a horse / animal warden.

    Made a call, the approriate body is to call out, apparently horses need to be tagged so that will at least give an indication to who ownes them. Even just to get them secured so they are not roaming around on the road.

    your neighbour does have some responsibility for not having stock proof fencing.
