Civil Case settled out of court does solicitor still normally get 10% of settlement m

    Hi there , my partner has had a civil case . It was settled after a day or two in front of a judge but it was settled out side of court we are wondering if his fees where covered but the other side and if so why does he want 10% on top of that and is this a normal practice .as it was never agreed upon on the first day she went in to speak with them all the agreed Upton was the term no win no fee .any help would be great in advance

    Unless specified in your settlement that costs are awarded against the other side you will be responsible for your solicitors fees.

    As for how much well this really should have been discussed from the beginning.

    Ask them much they are looking to be paid and ask for an invoice for their services

    It's a strictly prohibited practice: "In contentious business, a solicitor may not calculate fees or other charges as a percentage or proportion of any award or settlement."

    I'd raise the above with your solicitor in the first instance and then if appropriate, escalate to the Law Society. It's shambolic that that carry on is still happening in 2017.
