Leaking Flat Roof - Liability

    Hi all,
    We're in an awkward situation with our builder and architect and are wondering if anyone has heard of anything similar. We've been back in our house for 5 months now since it was renovated and extended. 3 months previous to this, (8 months ago in total) a leak occurred on the roof of the extension and the builder said he looked at it and got the roofing contractor to resolve it. Our architect didn't have any input on this and didn't seem bothered by it. 6 weeks ago, the leak reappeared, in roughly the same locations on the ceiling. (Roughly where the new roof meets the gable of the house) The roofing contractor was called again and insisted the leak is not his issue. The architect finally came out and met with the builder on site 2 weeks ago to review it. At that meeting they said they'll "monitor" it (without giving us a proper explanation as to what that means and the builder is now about to redecorate the water damaged ceiling and walls. It doesn't appear as if either want to investigate the source of the water coming in now that the roofing contractor has insisted it's not his issue.

    Our Defects Liability Period is 6 months so we're nearing the end of that as it's now 5 months since Practical Completion. This feels like they're both brushing this under the carpet as my understanding is that once the D.L.P. is up and the leak reappears (lets say in January), that we'll have to take the contractor to court to regain the costs for repairing the roof - which is an extra cost we couldn't afford. Does anyone have any advice or reassurance to give? The monitoring part sounds like a stalling tactic from both parties to be honest.
