Shared driveway

    Hi All,

We have recently moved into our in-laws home. Their house (old council house) shares a driveway with the neighboring house. Originally both houses would have had a pedestrian sized gate into the front garden with a shared driveway in the middle. Both houses would have had a steal fence up the length of the garden bordering the driveway on both sides. Over the years their/our house had a pillar removed for the pedestrian gate to enable access for a car. The neighboring house didn't do this and continued to use the shared driveway.

The neighboring house is rented and over the years different tenants have been fair with the drive or the complete opposite. One group kept a car there for 7 years and we had no access to the drive. My in-laws at the time didn't mind as they don't drive. The owners of the house are very uncooperative and don't want to even enter into discussion about resolving the driveway.

Ideally what we would like to do is build a wall from our side passage (which is half of the driveway) out to the front and place a pillar there. This obviously halves the neighbor's access, as they would need to move a pillar also if they still wanted to drive a car in.

Before I enter into a conversation with the neighbor (the last time this was with my in-laws, and left them badly shaken), I would like to get my ducks in a row so to speak. What mapping information or boundary information do I need ? do I need to find deeds for a definition of the driveway etc ?

Has anyone come across this before ? I've checked out other houses on the road and all have a wall down the middle and expanded entrances, which is essentially what we want to do.
